Welcome to the PCMD PLUS Services Agreement

This Agreement outlines your rights and obligations as a PCMD PLUS customer. This Agreement provides important information about PCMD PLUS; its services and terms of sale. Please take the time to read and understand it along with our privacy policy. PCMD PLUS might find it necessary to revise any or all of these policies at any time. If you do not accept this Professional Services Agreement in its entirety, you may not access or use the PCMD PLUS Computer Support services.

PCMD PLUS Service Agreement

YOU UNDERSTAND THAT BY CLICKING THE BUTTON TO CONTINUE OR BY USING THE PCMD PLUS SERVICES, YOU ARE AGREEING TO BE BOUND BY THIS SERVICE AGREEMENT IN THE SAME WAY THAT A PAPER CONTRACT BINDS YOU. USE OF THIS SITE AND COMPUTER SUPPORT SERVICES IS SUBJECT TO THE TERMS OF THIS SERVICE AGREEMENT AND THE POLICIES, TERMS AND INSTRUCTIONS REFERENCED IN THE SITE, WHICH ARE INCORPORATED AND CONSIDERED AS PART OF THESE TERMS. YOU MUST ACCEPT WITHOUT MODIFICATION ALL OF THE TERMS, CONDITIONS, POLICIES AND NOTICES REFERENCED IN THIS SERVICES AGREEMENT IN ORDER TO ACCESS AND USE THE SITE AND COMPUTER SUPPORT SERVICES. IF YOU DO NOT ACCEPT THIS SERVICES AGREEMENT IN ITS ENTIRETY, YOU MAY NOT ACCESS OR USE THE SITE OR COMPUTER SUPPORT SERVICES.

 1. Usage

You will provide PCMD PLUS with accurate and complete information including your email address. For the purpose of confirming your compliance with this Agreement, PCMD PLUS reserves the right to monitor and record activity on this site.

2. Fee, Payment and Transactions

Access to Computer Support Services is subject to the following fee; $50 minimum charge for up to one-half hour of support. If additional time is needed, you will be charged in half-hour increments at the rate of $85 per hour. You are responsible for the payment of all charges associated with the use of this site. You are also responsible for any fees or charges incurred to access this site through an Internet access provider or other third-party service.

3. Computer Support Services

Monday – Friday, 10:00 AM – 5:00 PM CST remote chat, diagnostic, and desktop sharing support. Payment to PCMD PLUS for computer support does not guarantee a solution and is provided on a “best efforts” basis. Support does not include any third party hardware or software.

Customer assumes all risk of loss of data from any and all causes or in any way related to or resulting from the sales, repair or service of products by PCMD PLUS.  You release PCMD PLUS from any claim or liability related to any loss of data for any reason whatsoever, including due to negligence of PCMD PLUS.  You agree that you are fully responsible for backing up all existing data before repairing or servicing your computer, and PCMD PLUS will have no liability for any reason whatsoever if you do not do so. 

4. Changes to the Site

PCMD PLUS reserves the right, in its discretion, to suspend, change, modify, add or remove portions of the Content available on this site at any time and to restrict the use and accessibility of this site.

5. Termination

PCMD PLUS may, in its discretion, immediately terminate or suspend your access to all or part of this site including any right to access and use this site with or without cause. The rights of termination are in addition to all other rights or remedies of PCMD PLUS provided in this Agreement or Terms & Conditions or by law.

6. Privacy Policy

The information that you provide about yourself to PCMD PLUS will only be used in accordance with the PCMD PLUS Privacy Statement.

7. Force Majeure

PCMD PLUS, its affiliates, licensees of PCMD PLUS and its information providers will not be liable or deemed to be in default for any delay or failure in performance or interruption of the delivery of the PCMD Plus website content resulting directly or indirectly from any cause or circumstance beyond its or their reasonable control, including but not limited to failure of electronic or mechanical equipment or communication lines, telephone or other connection problems, computer viruses, unauthorized access, theft, operator errors, severe weather, earthquakes or natural disasters, strikes or other labor problems, wars, or governmental restrictions.
